This is the fear. That the Republican would nominate a Republican to hold the seat until a special election can be held. Which may be a long time away. Anytime that the Republicans hold the majority (which they would with Cheney's tie-breaker) would be something to fear, say Democrats. It all looks moot, though, since you can take extended leaves of Congress without losing your seat.
